Raindance competition terms

To celebrate its sponsorship of the 18th Raindance Film Festival, Muvizu is inviting video submissions to a prize competition for the event.

Muvizu has, once again, asked Workstation Specialists, award-winning makers of high-end 3D- and CAD-oriented systems, to supply the prizes. These are:

A high-end mobile graphics workstation: WSM – Power 15.6” 3D Graphics Configuration
Intel® Core™ i7 720QM 1.60GHz 64Bit Quad-Core Processor

High-end graphics workstation: WS1600 High End 3D Graphics Configuration
Intel® Core™ i7 930 2.83GHz 64Bit Quad-Core Processor

Graphics workstation: WS1400 Powerful 3D Graphics Configuration

Winners will be announced after the 18th Raindance Film Festival.


How to enter? It's very simple:

- Create a video clip, about anything you like, of up to one minute and 30 seconds long using Muvizu 3D beta animation software. This is freely downloadable from www.muvizu.com - if you are not a Muvizu member, you must register as one (this is also free) to enter the competition

- Post your film on YouTube via the upload facility in the Muvizu 3D application or via your profile on the Muvizu website. When uploading, set the privacy option to "Private (only specific YouTube users can view)". You must also start the description of your competition entry film with the words "Submission for Muvizu prize competition at Raindance Film Festival" and send the url of your film to raindance@muvizu.com and include your name and preferred contact details. When we receive notification of your submission, we will email you at the address from which we received your entry with instructions to enable you to share your video with us so that we may pass it on for judging.

The final date for submissions is October 10, 2010. Entries will be judged by a Raindance-selected panel of experts and winners will be notified via the contact details they have provided.

Videos must be original works containing only material that you have created, or which is copyright-free; this applies to all images, audio tracks, music, embedded video files, dialogue and any other assets that you include in your work.

Your competition entry should be uploaded to YouTube at the highest resolution you can manage, so use the 1024 x 720 option. Be sure to keep the .set file from which the .avi file is outputted. If your entry is chosen as a winner, we may ask you to send us the .set file so that we may output it again at other resolutions.

You must be at least 13 years old to enter the competition in your own right, but if you are a dependent member of a Muvizu gatekeeper account, your gatekeeper may submit an entry or entries on behalf of you or your group.

The judges’ decision is final, and no cash or alternative prizes are available.

BEFORE YOU SUBMIT YOUR ENTRY, YOU MUST READ THESE TERMS AND CONDITIONS (“TERMS”).

BY SUBMITTING YOUR ENTRY, YOU AGREE TO THESE TERMS. BY SUBMITTING YOUR ENTRY FORM YOU ARE DEEMED TO HAVE ACCEPTED THESE TERMS.

IF YOU DO NOT AGREE TO THESE TERMS YOU MAY NOT ENTER THIS COMPETITION.

THE COMPETITION PROMOTER (RAINDANCE.TV PLC AND RAINDANCE FESTIVALS LTD) AND MUVIZU RESERVE THE RIGHT, AT ITS SOLE DISCRETION, TO CHANGE, MODIFY, ADD OR REMOVE PORTIONS OF THESE TERMS, AT ANY TIME. IT IS YOUR RESPONSIBILITY TO CHECK THESE TERMS PERIODICALLY FOR CHANGES.

DEFINITIONS

The Competition - means the Raindance Animation Short Film Festival competition to be held between July 22nd 2010 and August 31st 2010.

Entrants means any person or persons who intend to or who have submitted a film for the Competition.
Submitted Film means any film submitted for the purpose of qualification for the Competition.

ELIGIBILITY

1. Entrants may enter the Competition by posting a Submitted Film (the "Submitted Film") which is no more than 90 seconds (1 minute and 30 seconds).

2. The closing date for entries is midnight (GMT), 10 October 2010. All entries must have been received by the Competition Website by that time.

3. Entrants must be at least 13 years old on 10 October 2010 to submit an entry in their own right, but younger people belonging to a Muvizu gatekeeper account may have entries submitted on their behalf by their gatekeeper.

CONDITIONS OF ENTRY

4. Entrants may enter as many times as they wish. Each Submitted Film will be counted as a separate entry. Each entry must be submitted separately via an email to raindance@muvizu.com and the email must contain your contact details or, if you are under 13 years old, those of your gatekeeper.

• Sexually explicit or violent material or other material deemed by Muvizu and the Competition Promotor to be defamatory, offensive or inappropriate and/or which prevents the use of the material at any time of day or prevents the viewing by people of any age will be disqualified from the Competition.
• The Submitted Films must be original creations in their entirety and use the Muvizu software, but not necessarily exclusively the Muvizu software. All images and sounds to be included in the film and the entry material itself will have to be fully cleared for worldwide use on all media platforms. Entrants must ensure that any use of the entry material submitted shall not infringe the rights of any third parties or any applicable law, regulation, code, order, direction or bye-law.
• By entering the Competition, Entrants confirm that they have obtained consents from all artists, composers, writers, designers, voice-over artists and others whose performances or works are reproduced in the Submitted Films. By entering, Entrants agree to indemnify and keep Raindance and Muvizu fully indemnified from and against any claim, damage, loss (whether foreseeable or not), liability or cost including reasonable legal fees arising out of any failure on the entrant’s part to obtain the necessary consents or from any breach of these Terms.

5. By entering the Competition, Entrants irrevocably and unconditionally waive all moral rights which the Entrant may have and grants to Muvizu all rights necessary under the Copyright, Designs and Patents Act 1988 (or any modification or re-enactment thereof) to fully exploit such materials throughout the world as envisaged by and in accordance with these Terms and Conditions.

6. By entering the Competition, Entrants grant Muvizu an exclusive 6-month irrevocable, transferable, royalty-free world-wide licence of all copyright and other intellectual property rights in all pre-existing works submitted in support of their entries, in any and all media and whether now known or invented in the future and a none exclusive license for use (as defined above) thereafter . For the avoidance of doubt Entrants grant to Muvizu an unfettered, irrevocable, royalty-free, exclusive licence from the date of submission in perpetuity to show the Submitted Film worldwide in all media including but not limited to theatrical, TV, DVD, IPTV, Online, Mobile. During the first 6-month exclusive licence period Entrants whose Submitted Films have been selected for the Competition may publish their Submitted films on their own websites, which are promoted under their own name and hosted by themselves or on YouTube on or such other acknowledged social networking site such as Facebook or Twitter after the competition winners have been announced or and subject to Muvizu’s approval any other website or distribution platform BUT NOT OTHERWISE OR FOR ANY COMMERCIAL PURPOSE.

7. By entering the Competition, Entrants agree that Muvizu shall have the full right and power to edit, translate, dub or alter the entries (or accompanying material) in any way it sees fit in its sole discretion.

8. By entering the Competition, Entrants agree that if an entry does not comply with the technical, artistic or legal specifications set out within these Terms Raindance and Muvizu shall be within their rights to disqualify any such entries. Further, The Promotor and Muvizu shall have no obligation to provide explanations as to why an entry was disqualified.

9. By entering the Competition, Entrants agree that Muvizu and The Promoter shall be under no obligation to exploit, distribute and/or exhibit any entries and the Entrants shall have no claim against Muvizu and The Promoter in this regard.

10. The Winners will have provided a 90 seconds (1 minute 30 seconds) or less Submitted Film in accordance with these Terms. Winners will be chosen based on the originality and creativity of their entries. Winners will be chosen by a panel of judges from Raindance from all eligible entries received.

11. This Competition is free of charge and without purchase necessary, and is open to anyone who is 13 years of age or older, except employees of the Competition Partners, their agencies and anyone else connected with the creation and administration of the promotion.

12. Before submitting a film, participants must be registered on Muvizu.com

13. Entrants must also provide all additional data about themselves as may required or requested during the process of submitting their film.

14. By submitting a film Entrants automatically agree to the Competition Terms and Conditions.

DESCRIPTION OF PRIZE

15. The prizes are as follows:

Finalists up will also receive vouchers for selected Raindance training courses and a 1-year Raindance Membership.

It is a condition of each Winner accepting his/her prize that each Winner sign and agree to be bound by the Terms and Conditions in this document. Muvizu will be the owner of all rights in the work that each Winner has submitted however each Winner will also retain rights for certain non-commercial promotional use.

The winners of the prizes are responsible for all applicable expenses not specified in the prize description.

GENERAL

16. In the event that Raindance and/or Muvizu cannot for any reason contact one of the finalists within 14 days of the competition closing, they reserve the right to determine another Winner in his or her place. Winners will be announced after the 18th Raindance Film Festival.

17. The judges' decision is final. No correspondence will be entered into.

18. The Winner will be notified via the contact details they have provided and will receive written confirmation and full details of the prize within fourteen (14) days of the Winners being announced.

19. Runners Up will receive no personal notification.

20. Raindance and Muvizu reserve the right to select an alternative winner in the event that they have reasonable grounds for believing that an entrant has contravened any of these Terms.

21. The Winners may be required to provide a written acknowledgement of acceptance of all terms and conditions of the Competition as a condition to accepting the prize.

22. Entrants may be required to provide proof that they have obtained consents from all persons appearing in their entries, including but not limited to consents from all artists, composers, writers, designers, voiceover artists and others whose performances are reproduced in the film.

23. No responsibility can be accepted for entries lost, delayed, misdirected, damaged, or undelivered. Incomplete entries will be disqualified.

24. The prize is as stated and is non-transferable. If due to circumstances beyond Raindance and Muvizu that they are unable to provide the stated prize they reserve the right to award a substitute prize of equal value. All prizes are subject to the terms and conditions of the manufacturer or supplier.

25. Any personal information, including, without limitation, the entrant’s name, age, address (including postcode), telephone number and/or email address will be used solely in connection with this Competition and will not be disclosed to any third party except for the purpose of fulfilling prizes where applicable unless an entrant otherwise consents. Entrants name and email addresses will be used by The Promoter for the purposes of creating a free account on Raindance.tv and for newsletter sign up. Both of which the Entrant may remove their details from at any time by following the unsubscribe and account deletion processes set out in the newsletter and the Raindance.tv website respectively.

26. Entrants agree that they may be required to take part in publicity without further payment, but with their express consent. Such publicity may include using their names and/or likenesses.

27. The Promoter and Muvizu shall not be liable to the Winners or their legal representatives for any loss or damage or injury to the Winners or their property caused or suffered in connection with the Competition and/or prizes unless caused by Raindance and/or Muvizu’s negligence and recoverable on that ground.

28. Raindance and Muvizu do not guarantee any transmission, promotion, broadcast or other exhibition of work produced by the Winners and shall not be liable in any respect for any non-broadcast or non-exhibition of such works.

29. All Entrants agree to be bound by these Terms and Conditions as well as Muvizu’s standard Terms and Conditions which shall be found at www.muvizu.com., which may be amended or varied at any time by Muvizu and where relevant Raindance as the case may be.

30. "The Promoter" is Raindance.tv PLC and Raindance Film Festivals Ltd.

31. These rules shall be governed by and interpreted in accordance with English law and any disputes arising out of them shall be subject to the exclusive jurisdiction of the English courts in London.
